Terms of Service

Welcome to The Forever Space, a memorial platform operated by Jasper (“we,” “us,” or “our”). By accessing or using this site, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use the service.

1. The Service

The Forever Space lets you create online pet memorials — including photos, stories, tributes, and candle-lighting — and share them with the people you choose. Features may be updated, added, or removed over time, and we will endeavour to communicate significant changes in advance.

2. Eligibility and Accounts

You must be at least 16 years old to create an account. By registering, you confirm that the information you provide is accurate and that you will keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at hello@theforeverspace.com if you suspect unauthorised access.

3. Your Content

Ownership. You retain all intellectual property rights in the photos, text, and other material you upload (“Content”).

Licence to us. By uploading Content you grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display, and distribute that Content solely for the purpose of operating, improving, and promoting the service. This licence ends when you delete the Content or close your account, subject to reasonable technical delays.

Your responsibility. You represent that you have all rights necessary to upload your Content and that it does not infringe any third-party intellectual property, privacy, or other rights.

4. Acceptable Use

You agree not to:

  • Upload content that is unlawful, harmful, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Infringe any intellectual property or privacy rights of others.
  • Use the service to send unsolicited messages or advertising.
  • Attempt to gain unauthorised access to any part of the service or its infrastructure.
  • Reverse-engineer, scrape, or systematically extract data from the service without our prior written consent.
  • Use the service in any way that could damage, disable, or impair it.

We reserve the right to remove Content or suspend access at our discretion to protect users, comply with legal obligations, or enforce these terms.

5. Memorial Visibility

When you create a memorial you choose its visibility. Public memorials can be discovered and viewed by anyone. Private memorials are accessible only to people you invite via a shared link or direct invitation. You can change the visibility of a memorial at any time from your account settings. We do not actively moderate private memorial content except where required by law or in response to a valid complaint.

6. Subscriptions and Payments

Some features may require a paid subscription. Subscription fees are billed in advance on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer partial-period refunds except where required by applicable consumer law. If a payment fails, we may suspend access to paid features until the payment is resolved. Prices may change with at least 30 days’ notice.

7. Termination

You may close your account at any time from your account settings. We may suspend or terminate your access immediately if you breach these terms or if we are required to do so by law. On termination, your Content will be deleted within a reasonable period, except where retention is required by law. Sections 3 (licence ceases on deletion), 8, 9, and 10 survive termination.

8. Disclaimers

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. Nothing on this site constitutes professional grief counselling or legal advice.

9. Limitation of Liability

To the fullest extent permitted by law, Jasper and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising out of or relating to these terms or the service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) US $50. Some jurisdictions do not allow certain exclusions or limitations, so the above may not apply to you in full.

10. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. Any disputes will be resolved in the courts of San Francisco County, California, and you consent to personal jurisdiction there.

11. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email or by posting a prominent notice on the site at least 14 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated terms.
